Ordinances

For more details regarding the legal regulations, the Atomic Energy Act includes authorisations for issuing ordinances (compare listing in Section 54 paragraph 1 of the Atomic Energy Act). These ordinances require approval by the Bundesrat (Federal Council). The Bundesrat is a constitutional body of the Federation in which the governments of the Länder are represented.

    Repository Prepayment Ordinance

    The Federal Government has the task of setting up final storage facilities for radioactive waste. In accordance with the "polluter pays" principle, those obliged to pay in advance have to bear the necessary costs.

Regulations on technical plant safety or safe operation, publication of operating experience for the purpose of safety improvements, requirements for training and expertise or on various protective measures have so far not been made in Germany by legal ordinance, although this would be possible under the Atomic Energy Act, but are the subject of sublegal regulations.
